OVERVIEW OF FSSAI?

FSSAI Registration is for food businesses. It is wholly different than the FSSAI license. FSSAI Basic Registration can be availed online by filing the FSSAI registration form. There is an online system called Food Licensing and Registration System (FLRS), which is launched by FSSAI. Therefore, this link helps to apply for the Registration/License certificate. FLRS also helps in tracking your applications during the process. Nearly, 35 States/UTs have been issuing a License / Registration certificate online.

The FSSAI license is issued for 1 year to 5 years validity. Before 30 days of the expiry date, the renewal of the FSSAI license should be applied.

FOOD SAFETY COMPLIANCE SYSTEM (FoSCoS)

FSSAI has launched Food Safety Compliance System in the States/UTs of Tamil Nadu, Puducherry, Gujarat, Goa, Odisha, Manipur, Delhi, Chandigarh and Ladakh with effect from 01st June 2020. This system replaces the existing online Food Licensing and Registration System (FLRS:  https://foodlicensing.fssai.gov.in external link). Users of these States/UTs are now required to visit https://foscos.fssai.gov.in external link and login through same user IDs and passwords.  

Food Business Operators (FBOs) having License / Registration of premises at Indian Railways and concerned Authorities will continue to operate at Food Licensing and Registration System (FLRS) till further announcement.

TYPES OF FSSAI REGISTRATION?

  1. Central License for large food business
  2. State License for medium food business
  3. Basic registration for petty food business

Here, we are going to see how to register and what are all the documents needed for FSSAI registration.

TYPE OF FSSAI REGISTRATIONS

WHAT DOES FSSAI STAND FOR?

The term FSSAI is an acronym for ‘Food Safety and Standards Authority of India’.

FSSAI REGISTRATION APPLICABILITY?

As per Section 31(1) & 31(2) of FSS Act, 2006 every Food Business Operator in the country is required to be licensed/registered under the Food Safety &Standards Authority of India. The licensing and registration procedure and requirements are regulated by Food Safety & Standards (Licensing and Registration of food Business) Regulations, 2011.

Registration is meant for petty food manufacturers that includes petty retailer, hawker, itinerant vendor or a temporary stall holder or small or cottage scale industry having annual turnover up to 12 lacs. All food businesses having income more than this limit are required to take a license.

PROCEDURE FOR CENTRAL FSSAI REGISTRATION.

The FSSAI registration procedure and process are mentioned below.

Procedure for Central License Application

  1. According to the eligibility criteria, if you come in the category for Central License then you will be directed to the Central Licensing page where you have to fill out the application shown according to Food Safety and Standards Act 2006. Every data provided to the department should be correct and appropriate.
  2. Do make sure to write down generic names like coconut oil, flavored milk and not brand names.
  3. Make sure that the names of food products which you list must be approved products as per FSS Act 2006

4.If you want to add a new product then click on ‘Select Food Category’ in the screen of Food Processing Unit and from the drop-down menu select the food category. Fill all food items one by one but for clarity. Fill up all information correctly as the same will appear on your License.

  1. Next step is to download the form. you can even upload the form by using electronic signature.
  2. Now you are coming towards the end of the process. At last of the screen you will be asked for how many years you want to apply. You have to choose the appropriate period of time.

REQUIRED DOCUMENTS FOR FSSAI BASIC REGISTRATION:

  • Photo identity of the Food Business Operator
  • Document for Identity Proof like Ration Card, Voter ID Card, PAN Card, Driving License, Passport, Aadhaar Card, Senior Citizen Card, Department Issued ID
  • List of products planned 
  • Form – B (completed and signed)
  • Partnership Deed / Certificate of Incorporation / Articles of Association / Memorandum of Association
  • Proof of premises like rental agreement, etc.
  • Food safety management system plan
  • Supporting Documents (if any) like NOC by Municipality/Panchayat, Health NOC

PROCEDURE FOR STATE FSSAI REGISTRATION.

The FSSAI registration procedure and process are mentioned below.

Procedure for State License Application:

  1. After you have checked your eligibility and you are eligible for multi licenses then you can apply for state license individually.
  2. Based on the pre-check procedure if you are falling in the category for State License then you will be directed to the State Licensing page where you will fill out the application shown according to Ac of food security, 2006.
  3. The procedure for state licensing application is very similar to Central License Application. It is filled in the same way as of central. The process is similar to that of central license as mentioned above.

DOCUMENTS REQUIRED FOR THE OBTAINING THE STATE LICENSE:

Following are the documents needed for the State food License:

  1. Form B duly completed and signed.
  2. Plan of the processing unit revealing every dimension and operation-wise area allocation
  3. List of Directors/ Partners/ Proprietor along with the address, contact details, and photo ID
  4. Name and list of equipment and machinery to be used with the number and installed capacity
  5. List of food category to be manufactured
  6. Authority letter from a manufacturer
  7. Report of Analysis for water to be used in the process
  8. Proof of possession of premises
  9. Partnership deed/ affidavit of proprietorship
  10. NOC and copy of License from the manufacturer
  11. Copy of certificate obtained under the Coop Act 1861 or Multi-state Coop Act 2002
  12. Food safety management system plan or certificate
  13. Form IX
  14. Certificate from Ministry of Tourism
  15. Proof of possession of premises
  16. Partnership deed/ affidavit of proprietorship
  17. NOC and copy of License from the manufacturer
  18. NOC from the municipality or local body
  19. Food safety management system plan or certificate

RENEWAL OF FSSAI LICENSE:

Renewal of the FSSAI is as important as the registration of it. After the validity of a year, renewal of the FSSAI should be made in order to continue the business. The renewal sites are classified into five regional centers.

DOCUMENTS REQUIRED IN CASE OF RENEWAL OF FSSAI:

  1. Form -B duly competed and sign by the proprietor /partner or the authorized signatory
  2. Annual audit report/FSMS plan /certificate /self-Declaration regarding FSMS.
  3. FORM IX: Nomination of person by a company along with the Board resolution.
  4. Declaration form (in case of Delhi & Himachal Pradesh)

LIST OF PUNISHABLE OFFENCES AND THEIR SUBSEQUENT PENALTIES UNDER FSSAI COMPLIANCE

After you procure FSSAI license, you come under the supervision FFSAI regulatory authority. Thereby, it becomes indispensable to follow all the rules and regulations. In case you breach any of the provisions, then you may have to bear punishment and penalties.  Here is the catalogue of punishable offences and penalties imposed on the FBOs who don’t obey the FSSAI compliance checklist:

Penalty for selling unsafe food: – If a person is guilty to sell any unsafe food article for human consumption, he will be punishable where the contravention:

Offence of adulteration– Anyone responsible for the distribution of adulterated food shall pay the penalty up to Rs. 2 lakhs if the adulterant is not injurious to health and Rs. 10 lakhs if the adulterant is injurious to health.

Failure to comply with the FSS Act: – When a food business operator does not comply with the rules and regulations of FSS Act, then he will be liable for 2 lakh penalty.

Misleading consumers with false advertisement: – Any advertisement should not mislead the consumers about the substance, nature, or quality of the food; otherwise, one has to pay 10 lakhs due to false guarantee.

Misbranded food products: – Anyone found guilty of manufacturing or selling misbranded food products will be liable to pay a penalty of up to Rs. 3 lakhs.

Not selling quality food– Every food seller has to meet a prescribed food quality standard. In case a person fails to fulfil the statutory quality, then he has to bear a penalty of 5 lakh. Besides, if the person already falls under Sub-Section (2), Section 31 for any non-compliance, he is then liable to a penalty not exceeding to Rs. 25,000.

Running a food business without FSSAI license: – If any food business operator is guilty of not having a valid FSSAI license while running a food outlet, thereon he is liable to imprisonment of up to six months along with a fine up to Rs. 5 lakhs.

Does not result in major injury– Punishable for an imprisonment of up to 6 months and fine up to Rs. 1 Lakh.

Result in non-grievous injury– An imprisonment term of up to a year and fine up to Rs. 3 Lakh.

In case of grievous injury– The culprit shall bear an imprisonment term of up to 6 years and fine up to Rs. 5 Lakh.

Results in death– Since it is a major offence, so the concerned person is subject to an imprisonment of not less than 7 years that can further extend up to life imprisonment. Moreover, he also has to pay a penalty of not less than Rs. 10 Lakh.

WHAT IS FSSAI RETURN?

Every Business involved in food manufacturing, import, and export of food products or selling is required to file for the FSSAI annual return. Also, those who are involved in the manufacturing and distribution of dairy products should file for a half-yearly return. Each Food Business operator with the business turnover equivalent to or surpassing Rs. 12 lakhs must obtain the FSSAI license and file the return, respectively.

HOW CAN A PERSON FILE FSSAI RETURN?

All food business operators are required to obtain the FSSAI License and file the FSSAI return either electronically or Physically as may be prescribed by the concerned Food Safety Commissioner, in Form D-1, on or before 31st May of each year to the Licensing Authority concerning to the classification of food items manufactured or sold by him during the previous financial year.

ELUCIDATE THE PERSONS EXEMPTED FROM FSSAI ANNUAL RETURN?

Below- mentioned persons are exempted from FSSAI Annual Return-

  1. Fast food joints
  2. Restaurants
  3. Grocery stores
  4. Canteens

WHAT ARE THE CONSEQUENCES IF A PERSON FAILS TO FILE FSSAI RETURN ON TIME?

If a person fails to file FSSAI Return on time, he will be liable for a penalty of Rs. 100 which will be charged for every day for the time for which the delay continues.

WHAT ARE THE TYPES OF FSSAI RETURNS?
